Privacy Policy

I. Presentation

Dayming (“Dayming”, “We”, “Us”) respects your right to privacy and is committed to protecting your personal data (“Data”).

This Privacy Policy (the “Policy”) explains how we collect, process, store, share, and protect the Data that you provide to us or that we collect when you use our mobile application (“App”), browse our website (the “Website”), fill out our forms or questionnaires, or otherwise use our services (collectively, the “Services”).

Depending on the context of the Data you provide, we may act as a data controller or a data processor under this Policy. This Policy applies when we act as the controller of your personal data.

We reserve the right to amend this Policy at any time, at our sole discretion. Any modifications will be published via appropriate means, such as through a notice on the App’s home screen or the Website’s landing page. Changes will become effective thirty (30) days after their publication. Continued use of our Services after this period constitutes acceptance of the revised Policy.

This Policy should be read in conjunction with our Terms of Use. All capitalized terms not defined herein shall have the meanings given to them in the Terms of Use.

Some features of our Services may use artificial intelligence (AI). For more information about how AI is used in the App, please refer to the relevant section of the Terms of Use.

II. What Type of Data Do We Collect?

We collect and process personal data to provide and improve our Services. We may collect the following categories of Data:

1. Data you provide directly:

  • When you create or update your account: your name, email address, age, country, and any other information required to personalize your experience;

  • When you interact with the App: your goals, preferences, availability, declared habits, task completion history, and written inputs you voluntarily submit;

  • When you communicate with us: any message or feedback you send us, as well as information submitted through support requests or surveys.

You may choose not to provide certain Data, but this may impact your access to specific features or the quality of your experience with the App.

2. Data we collect automatically when you use the Services:

  • Usage information: interactions with the App, features used, progress through objectives, and engagement metrics;

  • Device and technical information: IP address, device type, operating system, language, and app version;

  • Diagnostic and performance data: app crashes, loading times, and bug reports, used to improve the App’s functionality;

  • Data from third-party platforms: if you connect the App to third-party services (e.g., app stores or authentication services), we may receive certain information such as your user ID or session data, in accordance with their privacy policies.

III. For Which Purposes Do We Use Your Data?

We process your Data to provide access to the Services, improve your user experience, and, where required, comply with legal obligations. In particular, your Data may be used for the following purposes:

  • To create and manage your account, including your profile and settings;

  • To operate and personalize the Services, including helping you achieve your personal goals and manage your activities within the App;

  • To improve the functionality and effectiveness of the App and its features;

  • To provide user support and respond to your requests, inquiries, or claims;

  • To communicate with you regarding your use of the Services and any questions or feedback you submit;

  • To inform you about other features or services offered by Dayming or its partners that may be relevant to you, subject to your communication preferences;

  • To prevent, detect, and investigate fraud, misuse, or other illegal activities, and if required, cooperate with public authorities;

  • To generate usage statistics and analytical reports, using anonymized or aggregated data;

To ensure the security and stability of the App and Services.

IV. Do We Use Cookies or Similar Technologies to Collect Your Data?

Yes, we use cookies and similar tracking technologies to enhance and secure your experience with our Services. Cookies are small text files that are stored on your device when you access the App or Website.

We use cookies for the following purposes:

  • To recognize you when you access the Services and secure your session;

  • To improve user experience by saving your settings and analyzing how you interact with the App;

  • To promote our Services or relevant partner offers, based on your usage and preferences;

  • To detect and prevent fraud or misuse of the Services.

Cookies may be stored:

  • Temporarily (session cookies), which are deleted once you close your browser;

  • Or for a longer period (persistent cookies), depending on the category and purpose.

You have the option to manage your cookie preferences at any time, including refusing or disabling certain categories of cookies through your browser settings.

Where applicable, your cookie consent preferences will be stored for a maximum of six (6) months, and no longer than thirteen (13) months. Data collected through cookies for analytics or marketing purposes will be retained for no more than twenty-five (25) months.

V. How We Store Your Data

We store your Data on secure servers located within the European Union for users based in Europe, and in the United States or other jurisdictions for users based elsewhere. Your Data is retained only for as long as necessary to fulfill the purposes for which it was collected and processed, and in accordance with applicable legal and regulatory obligations.

Your Data will remain in our active systems for the duration of your use of the Services. Upon termination of your use, it will either be:

  • Irreversibly deleted,

  • Anonymized,

  • Or archived in an intermediate database with restricted access, where required for legal or compliance purposes.

However, your contact information (such as email address) may be retained in our active database for a period of up to three (3) years after the end of your use of the Services, solely for the purpose of sending promotional communications regarding Dayming’s Services, unless you opt out.

In cases where we are legally obligated to retain Data (for example, for tax, accounting, or legal evidence purposes), your Data will be securely archived and deleted once the applicable statutory limitation or retention period has expired.

VI. Do We Transfer Your Data Outside the European Union?

Some of our service providers or team members may operate outside the European Union, including in countries where data protection laws differ from those within the EU.

When we transfer personal Data of users located in the European Union to countries outside the EU, we ensure that such transfers are carried out in compliance with applicable data protection regulations. This includes implementing adequate safeguards, such as:

  • Standard Contractual Clauses approved by the European Commission,

  • Binding Corporate Rules,

  • Or ensuring the recipient is located in a country deemed to provide an adequate level of data protection.

VII. How We Keep Your Data Secured

  • We are committed to protecting the security of your personal Data and implement security measures consistent with current industry standards to prevent unauthorized access, disclosure, alteration, or destruction of your Data.

    In particular, we have implemented:

    • Technical measures such as encryption (including SSL for data in transit), anonymization, and secure storage;

    • Organizational measures including access control, staff confidentiality obligations, and restricted access to archived data;

    • Physical safeguards for data center access and monitoring.

    However, no transmission or storage system can be guaranteed to be 100% secure. While we strive to protect your Data, we cannot guarantee absolute security. You also play an important role in safeguarding your Data and should take reasonable steps to protect your account credentials and personal information when using the Internet or the Application.

VIII. Which Rights Do You Have Regarding Your Data?

  • In accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR), you have the following rights concerning your personal Data:

    • Right of access: You may request access to your Data and obtain a copy of the information we hold about you, unless legal exceptions apply.

    • Right to rectification: You may correct or update your Data at any time by modifying your profile within the App or by contacting us directly.

    • Right to erasure: You may request the deletion of your Data, unless we are legally required to retain it for reasons such as public interest, compliance with legal obligations, or the defense of legal claims.

    • Right to restriction of processing: You may request that we restrict the processing of your Data if:

      • You contest the accuracy of the Data;

      • The processing is unlawful and you prefer restriction over deletion;

      • We no longer need the Data, but you require it for legal purposes;

      • You have objected to the processing and we are verifying whether our legitimate grounds override yours.

    • Right to data portability: Where technically feasible, you may request that your Data be transmitted to another data controller.

    • Right to object: You may object to the processing of your Data for reasons related to your personal situation. You may also object to processing for marketing purposes at any time.

    • Right to withdraw consent: Where the processing of your Data is based on your consent, you may withdraw your consent at any time.

    We will process your request within a reasonable timeframe, subject to legal obligations and the limits of your rights.

IX. How Do We Manage the Protection of Children?

  • We are committed to protecting the privacy of minors. Our App and Services are not designed for children, and we do not knowingly collect personal Data from individuals under the age of 15.

    When signing up, users are required to confirm that they are at least 18 years old, or that they have obtained parental consent if they are between 15 and 18 years old. Without such consent, we do not authorize access to the Services.

    For minors (under 18), we may limit how their Data is collected, used, and stored. This means that some features, including certain activities or challenges within the App, may not be accessible to these users.

    If we become aware that we have collected Data from a child without appropriate consent, we will delete it promptly.

X. With Whom We Share Your Data

  • We may share your personal Data with internal teams, including members of our IT, development, and marketing departments, for the purpose of delivering, maintaining, and improving the Services and your user experience.

    We also share your Data with trusted third-party service providers acting on our behalf, including but not limited to:

    • Cloud hosting and infrastructure providers;

    • Payment processors handling Subscription payments;

    • Communication platforms used to send promotional or transactional messages;

    • Fraud detection and analytics tools;

    • Providers of statistical or performance-related services.

    All third parties with whom we share your Data are contractually bound to protect your personal Data in accordance with this Privacy Policy and applicable data protection regulations. We ensure that they implement appropriate technical and organizational measures to maintain the confidentiality and integrity of your Data.

    Additionally:

    • We may share your Data with other users of the App when you explicitly request to interact or communicate with them through Dayming;

    • We may share your Data with selected partners for marketing purposes only with your explicit consent;

    We may disclose your Data to competent legal authorities when required to do so by law, regulation, or court order. In such cases, unless prohibited, we will inform you of the disclosure.

XI. Third-Party Website Links and Advertising

  • Our Services may include links to third-party websites, platforms, or content. These third parties operate independently from Dayming and may have their own privacy policies and data practices. We are not responsible for how these third parties collect, use, or protect your Data, and we encourage you to review their privacy policies before interacting with their content or services.

    In addition, we may collaborate with third-party advertising networks or platforms, such as Google, Meta (Facebook, Instagram), or other ad providers, to promote our Services. These platforms may use cookies, web beacons, or similar technologies to collect behavioral information across websites and apps for interest-based advertising purposes. However, we do not share any content you submit within the Dayming App (such as goals, activities, or personal notes) with advertisers.

    We do not control the data collection practices of these advertisers and recommend that you contact them directly if you have questions about their data use. You may also adjust your advertising preferences via your device settings or platform-specific tools (e.g., Google Ads Settings, Facebook Ad Preferences).
